How long do you have to pursue unpaid debt?

The length of time that you have to pursue bad debt varies by state to state, in Australia. As a general rule of thumb, you have up to 6-years to pursue the bad debt. The period starts from the date the action occurred or the date the debtor last acknowledged the debt. Debt acknowledgement includes making a payment on a debt or admitting in writing or person that the debt is theirs.
So, as an example, if you’re attempting to collect on a debt that was last acknowledged by a client 3-years ago, you have 3 more years to chase the debt down and attempt to get payment. After this term ends, the debt becomes statute-barred by law, and you are no longer allowed to attempt to collect on it.
This time-frame varies in the Northern Territory. The statute of limitation is 3-years from the time of the last acknowledgement by the debtor.
Once these periods end the right to pursue repayment or court action expires. The debtor legally doesn’t have to repay any debts that are statute-barred. This is why it is imperative that you proceed with collections actions as early as feasible. The longer these debts stagnate and have no action performed on them, the harder they become to collect on. The faster you act, the higher the chance of a successful resolution.
