What is debt collection and what does a debt collector do?

Debt collection is the act of pursuing overdue money owed to you by clients. Generally, a business or individual will hire a debt collector to follow up on their overdue files. The goal of debt collection is to get the owed money repaid. It is most common for companies to outsource their overdue debt files to a debt collector. However, sometimes larger companies will have in-house debt collection specialists who will attempt to get the overdue files settled.

In Australia, there is a significant amount of legislation surrounding what a debt collector can and cannot do. This legislation is designed to protect both the debtor and the debt collector. Providing that an account has been overdue for long enough, businesses can hand them over to a professional debt collector. Once the files have been handed over to the experts, it is then up to the debt collector to follow up on the unpaid balance.

From here the debt collector will attempt to make contact with the debtor. If they’re unable to make contact, they’ll get in touch with friends and family. This is allowed, as long as they do not provide any specific details as to why they’re calling the debtors contacts.

If these steps do not lead to a successful resolution, the debt collector may take the collection actions a step further. This is where the services of a private investigator are utilised to track the debtor down. This can help confirm that the details they have for the debtor are in fact still up to date and correct.

If by some small chance they are still unable to gain a successful resolution, they may lodge a claim with the courts. This is always a last resort and is taken reluctantly if all other avenues have been exhausted.

We offer tailored solutions for your business.

We believe that offering tailored solutions to our clients is the key to success. Each case is going to be unique and therefore requires an individualised approach. We always go above and beyond to offer this personalised solution to our clients. We utilise 23-years experience in the industry to determine the best strategy for success. Our specialist case managers have the resources and skills to adapt to all scenarios to gain that successful resolution.

We’re aware of the fact that in many cases, you may need to maintain a good relationship with your clients. Keeping this in mind, we have systems in place to ensure that we acct as an extension of your accounts. This helps maintain the good relationship with your clients while getting those tricky debts sorted.

We also understand how frustrating it can be dealing with multiple people throughout the process. With this in mind, we allocate an expert case manager to you for all your debt collection needs. This means that you’ll have an expert who will know your cases inside and out and you won’t have to deal with multiple people. Just one person who is consistently up to date with your files. They’ll know everything from amounts owing and paid, to costs incurred and the current status of your accounts. They’ll have your answer.

The flexibility of our tailored solutions really does allow for the greatest chance of success. Our unique approach will result in your hard-earned money going back to where it belongs, specifically,  your pocket.

Who uses the services of a debt collector?

Many businesses will utilise the services of a debt collector at some point during their lifetime. Unfortunately, the reality is that whether big or small, most businesses will need a collections specialist to chase up an overdue file or two. This is why ProfColl makes their service available to all businesses, small or large.

We understand that for many businesses, especially the smaller ones, that the continuation of the client-business relationship is essential. This makes it imperative to have a professional yet discreet debt collection agency on hand who know how to maintain these relationships, while successfully resolving your unpaid debt files.

How long do you have to pursue unpaid debt?

Australia has a significant number of laws that govern how long you can pursue bad debt. These are designed to protect both the debtor and the collections specialists and regularise the process.

The length of time that you have to pursue bad debt varies by state to state, in Australia. As a general rule of thumb, you have up to 6-years to pursue the bad debt. The period starts from the date the action occurred or the date the debtor last acknowledged the debt. Debt acknowledgement includes making a payment on a debt or admitting in writing or person that the debt is theirs.

So, as an example, if you’re attempting to collect on a debt that was last acknowledged by a client 3-years ago, you have 3 more years to chase the debt down and attempt to get payment. After this term ends, the debt becomes statute-barred by law, and you are no longer allowed to attempt to collect on it.

This time-frame varies in the Northern Territory. The statute of limitation is 3-years from the time of the last acknowledgement by the debtor.

Once these periods end the right to pursue repayment or court action expires. The debtor legally doesn’t have to repay any debts that are statute-barred. This is why it is imperative that you proceed with collections actions as early as feasible. The longer these debts stagnate and have no action performed on them, the harder they become to collect on. The faster you act, the higher the chance of a successful resolution.

All manner of businesses can utilise the services of a debt collector.

Having a few unpaid invoices may not be a big problem for some larger companies out there. However, for a much smaller operation, cash flow is key. Every single dollar counts and those unpaid invoices may be the difference in continuing to trade or not. This can be seen for example in a small start-up business or a trades business. Without that hard-earned money coming back into the business, it could be a disaster. We don’t want to that to happen.

Every invoice that goes unpaid has a cumulative effect on your resources, like a snowflake turning into the much larger problem of a snowball or even an avalanche. For every file that remains outstanding, the business is losing valuable income and cash-flow.

This is why we’re not just a collection agency for the Fortune 500’s. We’re here to help out the little guys as well. With our no joining fees, no lock-in contracts and our intuitive and flexible solutions, we’ll get you sorted, fast. Just because your business is small, it doesn’t mean it’s not important. We’re firm believers that every business should have access to a reliable debt collector to get those stubborn invoices resolved.
